When something is jointly owned and in use by the owners of different properties, it may be desirable to lay down how each should treat their share of the joint property. With a common building wall, don't think about the co-owner tearing down part of that wall

Building wall

Such a wall is mandible by virtue of zoning, which means that none of the owners can alienate their share in the wall other than as part of the alienation of the whole property. Also, you can only decide on changes and/or maintenance together. For example, if the foundation under that wall needs to be addressed.

Management foundation

A common road, car park or bridge, can be designated as a mandelage. This means that it is established for the benefit of which real estate it extends. This allows an owner to transfer it alone, together with the real estate for whose benefit it extends.
The deed recording this can then also stipulate how the use, maintenance, replacement and cost-sharing thereof will be arranged. In more complex situations, it is sometimes useful to work with a flat division or to create a management foundation with affiliates.
