Registered partnership is different from being registered together at the same address in Rotterdam or making a cohabitation agreement. Entering into a registered partnership is subject to the same formalities as entering into a marriage in Rotterdam or elsewhere. It also has virtually the same consequences.

Partnership conditions for registered partnership in Rotterdam

As with marriage, partners who wish to enter into a registered partnership can opt for community of property, or deviate from it. Deviation is done by drawing up partnership conditions. One difference with marriage is that registered partners do not have to go to court for a divorce, unless they have minor children. Registered partners without minor children can dissolve the registered partnership with the help of a notary or lawyer through the registrar of births, marriages and deaths.

A registered partnership with community of property

In communities of property created before 1 January 2018, everything is common. When that community came into existence after 1 January 2018, everything that was private before the registered partnership remains the property of the person who had it. Anything added during the registered partnership becomes common. If one partner has a claim against the other partner because of the purchase of a joint house, they will lose part of the claim. Similarly, if there is a business of their own, the other partner may suddenly have a claim to part of the value accrued in the business.
