Onerous provisions

Provisions that limit the right of ownership or limited rights such as a right of emphyteusis are called onerous provisions.

Onerous clauses may take the form of an easement, qualitative obligation or penalty/chain clause.

Onerous clauses can also result from government regulations, such as designation as a national monument or a designation under the Soil Protection Act.
