The Notary Act states that the office of notary entails the power to execute authentic deeds in the cases in which the law requires him to do so or a party requires him to do so, and to perform other activities assigned to him by law. The notary therefore performs, among other things, a state function.

In addition, the law requires a notary to be independent and not to be employed. A notary must therefore be an entrepreneur.

To be appointed as a notary or additional notary, a person must have studied notarial law, have worked as a candidate notary in a notary's office for six years and have completed his professional training. He must then go through a very extensive appointment process before being appointed by the King.
After the appointment, he is sworn in by the judge.

Drawing up a notarial deed is sometimes the only way to give form to a legal act, such as a will or a mortgage deed. A notarial deed provides legal certainty and probative value.
