When someone cannot manage their financial and personal affairs themselves, someone else will (have to) do so.
For minors, the law regulates this through parental authority or guardianship.

If an adult cannot manage their financial and personal affairs themselves, they can be placed under guardianship by the cantonal judge. The subdistrict court does so if it has found that the adult temporarily or permanently does not properly look after his interests or endangers his safety or that of others, as a result of:

  • his physical or mental condition, or
  • habit of alcohol or drug abuse.

The cantonal judge may also choose to institute the less far-reaching guardianship or mentorship.
A guardian then makes decisions about assets, care, nursing, treatment or supervision of the person under guardianship. If you are under guardianship, you are incapacitated. This means that you cannot perform legal acts without the curator's permission. If someone is placed under guardianship this is registered in the guardianship and administration register at the court.
