When preparing a deed, we take into account the personal circumstances of the parties involved and the (tax) laws and regulations at the time. In consultation with the client, we also try to take into account possible changes in those circumstances and in laws and regulations.
In, for example, wills, prenuptial agreements, articles of association and shareholders' agreements, we try as much as possible to regulate not only the current situation but also future situations. In practice, however, not all changes in personal circumstances can be foreseen. Legislation also often changes in unexpected ways. In recent years, for example, several laws have been radically changed, such as inheritance law in 2003, the Income Tax Act in 2001, the Inheritance Tax Act in 2010, BV law in 2012 and matrimonial property law in 2012 and 2018. These changes can have a major impact on existing deeds.
It is therefore very important to have a review at least every five years to ensure that everything is still up-to-date and still suits your personal circumstances at that time.
